Tennessee Medicare Advantage and Other Senior Plans (TN)

Medical Advantage plans are supplementary health insurance for people who already have Medicare Part A (hospital) and B (optional medical insurance). They are generally of the following formats:

  • Preferred Provider Organizations (PPO)
  • Private Fee-for-Service Plans (PFFS)
  • Medicare Medical Savings Account (MSA) Plans
  • Medicare Special Needs Plans

Because it is part of the reform under the Medicare Prescription Drug, Modernization and Improvement Act (MMA) passed by Congress in 2003, Medicare Advantage plan providers are subject to laws enforced in its state of coverage as well as the federal government.

States such as Tennessee reserve the right to license an Medicare Advantage plan provider, as well as determine the guidelines for said licensure within its area of responsibility based on state laws, but laws established by the Centers of Medicare and Medicaid Services (CMS) under federal law such as unacceptable marketing practices for Plan C or D* under Medicare Marketing Guidelines are enforced by the CMS under federal government decree. States may report such violations to the CMS but may not take any other action against the alleged transgressor. For providers who are found to contravene state or federal laws, approval from the Medicare system can be withdrawn. If there is any indication of illegal or unscrupulous practice by the service provider, complaints may be reported to 1-800-MEDICARE.
