Oregon Medicare and Senior Health Information (OR)
Before January 2006, the coverage gaps in the original Medicare were shifted onto a separate, optional Medigap policy. Although Medigap policies are handled by privately-owned insurance companies, they were rigidly structured, following one of 12 standard sets of benefits no matter the insurance provider. While this made plan comparisons among the insurers easy to do, it also made it harder to find a plan that fitted any particular set of health considerations. With the advent of Medical Advantage and other supplementary Medicare plan options under the Medicare Prescription Drug Modernization and Improvement Act (MMA) passed by Congress in 2003, this became easier because of the more flexible regulation of such plans. However, Medicare Advantage plans still need to follow state and federal insurance laws, especially with regard to marketing.

When enrolled in an Medicare Advantage plan, the Medigap policy that may be in force will be automatically nullified; in other words, deductibles, co-payments and other cost-sharing mechanisms under Medigap is superseded by the Medicare Advantage plan. However, once the Medigap policy is dropped, eligibility for re-enrolling will only occur under special circumstances.
